These GTC shall apply to purchase requests submitted via our homepage www.siebensachen.com and to purchase requests by phone at +49. [0]30. 308 720. 74 and by fax at +49. [0]30. 308 720. 75.
We expressly reserve the right to change our General Terms and Conditions at any time. You are kindly requested to check our GTC before submitting your purchase request.
General
Your contractual partner is siebensachen Designvertrieb, Jörg Adam und Dominik Harborth GbR, Augustenstrasse 27, 80333 Munich [business enterprise no. A03018619], hereinafter referred to as siebensachen.
For all business relations between siebensachen and the Buyer, the following General Terms and Conditions for sales to ultimate customers, as amended at the time of the purchase request, shall be exclusively valid.
Conclusion of Contract
All offers presented at our Internet shop are subject to change without notice and are not binding. Minor deviations from our descriptions or illustrations are possible.
If you offer to purchase an item at www.siebensachen.com we will acknowledge receipt of your request and its details by email [acknowledgement of receipt]. This acknowledgement does not constitute an acceptance of your offer, but is merely intended to inform you of its due receipt. A purchase agreement will not be deemed concluded until we dispatch the goods or send you an email order confirmation.
The contract language will be German. The text of the contract will not be saved.
Reservation of Availability
The acceptance of your purchase request will be subject to the item's availability. Should the item not be available, siebensachen will be free to withdraw its offer to sell. As an alternative, we may suggest a subsequent delivery of the article on the basis of an updated delivery time. Details will be advised in a corresponding email. You will receive the article in question immediately upon availability. If you do not wish to receive a subsequent delivery, please advise us by phone or email. Any payments already effected by you will be refunded without delay should a purchase agreement not be concluded.
Prices
Prices include the statutory value-added tax [VAT] of 19% for customers in EU-countries. Shipping costs will be charged separately and will be listed in the invoice as a separate item. The delivery address is decisive.
For customers outside the EU all prices are to be understood as net prices. The delivery address is decisive. Any value-added tax [VAT] payable in the recipient country in accordance with statutory provisions shall be paid as an additional amount upon receipt of the goods. Import duties, if any, shall also be paid by the Buyer upon receipt of the goods.
Delivery
Goods will be shipped by GLS [Global Logistic Service] within Germany and to EU member countries, including Switzerland; with the exception of the Azores, Baleares, Ceuta, Faroe Islands, Greece, Greenland, Canary Islands, Corsica, Madeira, Malta, Melilla, Turkey and Cyprus.
As a rule, all items available ex stock leave our company within 2 working days.
All information about availability and delivery dates is to be understood as approximate and tentative, and hence without engagement. We will do our utmost to adhere to indicated delivery times.
Delivery costs
Within Germany
For order values of EUR 50.00 [incl. statutory VAT] or more the order is free of shipping costs within Germany. For each purchase order of less than EUR 50.00 [incl. statutory VAT] we will charge a flat fee of EUR 3.00 per packing unit up to 0.2 kg for handling and delivery [incl. statutory VAT]. From a shipping weight over 0.2 kg we will charge a flat fee of EUR 4.50 [incl. statutory VAT] per packing unit for handling and delivery [incl. statutory VAT].
Delivery includes appropriate insurance cover by GLS [Global Logistic Service], DHL or Deutsche Post.
Within EU
For order values of EUR 150.00 [incl. statutory VAT] or more the order is free of shipping costs within the EU member countries; with the exception of the Azores, Baleares, Ceuta, Faroe Islands, Greece, Greenland, Canary Islands, Corsica, Madeira, Malta, Melilla, Turkey and Cyprus.

Attention Switzerland!
Swiss Citizens should note that the return and exchange of goods from Switzerland is extremly difficult and expensive due to customs and tax regulations. Refund of the duty and the import sales tax that has already been paid on the imported goods is subject to a very tedious and complex procedure. It may only be refunded after deducting fees. Mode of Payment and Payment Terms
Credit Card
You can pay your order by credit card. We accept Visa, MasterCard, American Express, Discover, Diners Club and Job. In the checkout process you enter the card number, cardholder name, the expiration date and the security code (CVV). You will find it on the back of your credit card – it’s the last 3 or 4 digits. Providing your goods are in stock we will dispatch your order as soon as your payment has been cleared by our payment service PAYMILL. A printed invoice with confirmation of payment will be included to your delivery.
Sofortüberweisung
You can pay your order by Sofortüberweisung. In the checkout process you will be redirected to an already completed money transfer form. You select your bank by your bank code number and enter your login details for online banking into a secure payment form. By TAN input you confirm your transfer. Providing your goods are in stock we will dispatch your order. A printed invoice will be included to your delivery.
PayPal
You can pay your order by PayPal. The order process is particularly short and cheap with PayPal. Due to the fast purchase process with just a few clicks and entries PayPal is predestined for mobile payments on smartphones and tablets. Providing your goods are in stock we will dispatch your order as soon as your payment has been cleared by PayPal. A printed invoice with confirmation of payment will be included to your delivery.
Payment in advance
You can pay your order by payment in advance. After you finished the checkout process, you will automatically receive an email with the information you need for the bank transfer. Providing your goods are in stock we will dispatch your order as soon as your payment has been cleared by our bank. A printed invoice with confirmation of payment will be included to your delivery. Please notice: Within Germany, a bank transfer takes about 1-2 days, transfers from abroad take about 4-5 days.

Clients from Germany and Austria can pay their order by payment by invoice. Providing your goods are in stock we will dispatch your order. A printed invoice will be included to your delivery. It is payable within 10 days without any deductions.
Reservation of Title
All goods will remain the property of siebensachen until the complete payment of all receivables under the delivery agreement.
Instructions on withdrawal
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
Please note: Customized productions – e.g. goods with individual engraving, imprint and / or special packaging – are generally excluded from any withdrawal or exchange.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Warranty and Liability
As a subsequent performance, the Buyer may at his discretion require the elimination of the defect or the delivery of non-defective goods. We are, however, entitled to reject the type of subsequent performance chosen by the Buyer, if it is only possible at unreasonable costs, and the alternative form of subsequent performance does not involve substantial disadvantages for the Buyer. During the period of subsequent performance, any reduction of the purchase price or a rescission of contract by the Buyer shall be excluded. If the subsequent performance is carried out as a replacement delivery, the Buyer shall be obliged to return to siebensachen the goods delivered first. Any subsequent performance will not be effected until the receipt of these goods. Exceptions shall be subject to a special agreement. A subsequent improvement shall be deemed a failure with the second unsuccessful attempt, unless a different conclusion is appropriate in particular with regard to the nature of the goods or defect or in view of other circumstances. In case of a failed subsequent performance or a refusal of subsequent performance on our part, the Buyer will at his discretion be entitled to rescind the contract, to claim a corresponding reduction of the purchase price or to choose another available article.
Any claims for damages against us may only be asserted for damage caused by intent or gross negligence on our part. Our obligation to pay damages will only cover direct, predictable damage. If essential contractual obligations have been violated or if this violation has resulted in injury to life, body, or health, we shall also be liable for slight negligence.
The warranty period is for 2 years after delivery of the goods.
Data protection
siebensachen undertakes to use any data collected, processed and stored in connection with the registration and utilization of its services by the individual customer for internal purposes only and not to pass them on to any third party, unless obliged to do so by statutory or official provisions. All personal data will of course be treated confidentially. All personal data will only be collected, processed and used as permitted by law and will only be used within the scope of order processing. The commissioned forwarding agent or parcel service will receive Buyer's address for the delivery of the goods. The Buyer agrees to the collection, processing, use and storage of his data for the processing of his order.
